1.   What is this lawsuit about?
This class action lawsuit was brought on behalf of individuals or entities who purchased or acquired PolyMedica common stock between October 26, 1998 and December 31, 2000, inclusive (the “Class Period”) against Defendants PolyMedica, Liberty and Steven J. Lee, Warren K. Trowbridge and Eric G. Walters. The reason for the lawsuit is it was alleged that the Defendants knowingly engaged in a fraudulent scheme to issue materially false and misleading statements regarding PolyMedica and Liberty’s financial condition and compliance with Medicare regulations and whether such statements were made with fraudulent intent. The Defendants deny that they are liable to the plaintiffs or the Class and deny that the plaintiffs or the Class have suffered any damages.

2.   Am I a Class Member?
You are a Class member if you purchased or acquired PolyMedica common stock between October 26, 1998 and December 31, 2000, inclusive (the “Class Period”), are not a Defendant, officer and director of PolyMedica and/or Liberty during the Class Period, member of the Defendants’ immediate families and their heirs, successor or assign, and did not engage in any short-sale transaction of PolyMedica common stock during the Class Period.

3.   What do I do to get payment?
The only way to get payment from the Settlement Fund is to file the Proof of Claim form. You must complete and sign the Proof of Claim and mail it postmarked no later than October 26, 2007 to the Claims Administrator at: PolyMedica Securities Litigation, c/o FRG Information Systems Corp., P.O. Box 460, Peck Slip Station, New York, NY 10272-0460.

4.   What do I do to exclude myself from the Class?
To exclude yourself from the Class, you should you must mail a written request for exclusion from the Class, postmarked no later than August 22, 2007, addressed to: Shapiro Haber & Urmy LLP, 53 State St., Boston, MA 02109, Attn: PolyMedica Class Action. The request for exclusion must:

  1. set forth the name, address and the telephone number of the person requesting exclusion;
  2. set forth the date(s), price(s), and number(s) of shares of all your purchases, acquisitions, and sales of PolyMedica common stock during the Class Period;
  3. state that the person requesting exclusion "requests exclusion from the Class in In re PolyMedica Corp. Securities Litigation, Civil Action No. 00-1 2426-WGY";
  4. be signed by the person requesting exclusion.
You cannot exclude yourself by telephone or by e-mail.
